CLARITY Act Faces Long Odds: Regulators Fill The Gap

The U.S. Senate failed to advance the CLARITY Act on September 15 after a procedural vote ended 49–50, falling short of the 60 votes required to move the cryptocurrency market-structure bill forward. 

The failed vote represents a major setback for the CLARITY Act and makes enactment in 2026 considerably more difficult, although the procedural vote itself does not permanently kill the legislation.

Bitcoin, XRP, Solana, and crypto-linked stocks fell sharply in the hours following the vote.

What the CLARITY Act Senate Vote Means for Crypto Markets 

Wall Street research and brokerage firm Bernstein earlier warned in their client note, that failure of the CLARITY Act could trigger a negative reaction across digital-asset markets. The firm said, however, that the impact could be temporary as the SEC and CFTC accelerate crypto rulemaking under the Trump administration’s Project Crypto initiative. 

Bernstein analysts expect regulators could move faster on token classification, DeFi and self-custody rules, and exemptions for token issuance. 

Bernstein’s Earlier Warning Comes Into Focus After Senate Vote 

Bernstein had also warned in an August client note that a CLARITY Act failure could trigger another leg lower for crypto markets. 

The firm’s previously reported scenario called for Bitcoin price to test the $55,000-$60,000 range, representing a potential 10%-25% correction, while altcoins could fall 15%-30%.  The analysts said tokens most dependent on regulatory clarity, including exchange and DeFi governance tokens, could face the greatest pressure.

Existing spot bitcoin ETFs, meanwhile, would not necessarily be directly affected by the legislation’s failure, while the regulatory path for newer products such as tokenized securities and on-chain derivatives could remain more dependent on future rulemaking and legislation.

Bitcoin, XRP and Solana Fall After CLARITY Act Vote 

Bitcoin (BTC) fell 2.1% to $75,800, while Ethereum (ETH) dropped 3.4% to $2,400. The sell-off was steeper among major altcoins, with XRP sliding 8.3% to $1.29 and Solana falling 4.1% to $97.4, according to CoinGecko data.

The total cryptocurrency market capitalization fell to about $2.72 trillion, down 2.7% over the past 24 hours.

The decline came alongside a sharp sell-off in crypto-related stocks. Coinbase Global (COIN) and Circle Internet Group (CRCL) fell as much as 10.10% and 11.41%, respectively, during the trading session.

What’s Next?

Markets are also heading into a closely watched Federal Reserve decision, while DeFi continues to report strong growth in dollar-denominated total value locked (TVL).

The Fed is meeting today, Sept. 16, with markets pricing in about a 93% chance of a rate hike. The decision is the next major event investors are watching for its potential impact on crypto markets.

Why the CLARITY Act Matters 

The CLARITY Act is widely regarded as one of the crypto industry’s most significant pieces of U.S. legislation. The bill is intended to establish clearer rules for digital assets, reduce regulatory uncertainty and encourage broader institutional adoption. 

Its passage could also improve market confidence by giving banks, asset managers and exchanges greater clarity to invest in blockchain infrastructure and expand their crypto offerings.
